Extradição: Desqualificação do Crime de Seqüestro e Morte Presumida

O Tribunal iniciou julgamento de extradição formulada, com base em tratado bilateral, pelo Governo da Argentina contra nacional uruguaio, a fim de submetê-lo a processo judicial no qual lhe é imputada a prática dos crimes de privação de liberdade e de associação ilícita, previstos, respectivamente, nos artigos 144, alínea 1ª, e 210, ambos do Código Penal argentino. Alega o Estado requerente que, durante a denominada "Operação Condor", "identificada como uma organização terrorista, secreta e multinacional para caçar adversários políticos" dos regimes militares do Brasil, Argentina, Chile, Uruguai, Paraguai e Bolívia nas décadas de 1970 e 1980, o extraditando, à época, Major do Exército uruguaio, teria participado de ações militares que resultaram no seqüestro de pessoas, dentre as quais um cidadão argentino, levadas a uma fábrica abandonada e lá submetidas a interrogatórios e torturas. The protection of human rights and international penal cooperation demand efficient measures in order to combat terrorism, as long as one observes juridical certainty and security. Nevertheless, the absence of a definition of terrorism, in its international and national context, allied with the diversity of conceptions, particularly the ones related to the subjective character of terrorism, in relation to political crime, challenge the rational fundamentals of judicial decision.  The intricacies become relevant when one ascertains that innumerable Latin American and Iberian Constitutions forbid the extradition of a political criminal with the latter generally being granted protection.
